The Smoking Shelter legislation across the UK is as follows; A building fails to qualify for a smoking shelter if it is deemed to be "substantially enclosed". The definition of this term follows; Substantially Enclosed - Premises are substantially enclosed if they have a ceiling or roof, but there are permanent openings in the walls which are less than half of the total areas of walls, including other structures which serve the purpose of walls and constitute the perimeter of premises. This is known as the 50% rule. A roof includes any fixed or movable structures, such as canvas awnings. Regarding the use of the Grillikota huts to be used as a smoking shelter we are in agreement that with three of the six sides removed as plan and the calculations you supplied this shelter would comply with the 50% open rule within relevant smoke free legislation.
